Who are refugees? Who, if anyone, is responsible for protecting them? What forms should this protection take? In a world of people fleeing from civil wars, state failure, and environmental disasters, these are ethically and politically pressing questions.

In this book, David Owen reveals how the contemporary politics of refuge is structured by two rival historical pictures of refugees. In reconstructing this history, he advocates an understanding of refugeehood that moves us beyond our current impasse by distinguishing between what is owed to refugees in general and what is owed to different types of refugee. He provides an account of refugee protection and the forms of international cooperation required to implement it that is responsive to the claims of both refugees and states.

At a time when refugee protection is once again prominent on the international agenda, this book offers a guide to understanding the challenges this topic raises and shows why addressing it matters for all of us.

Albanian asylum claims: making a difference

All asylum seekers, including children and young people, find that the starting point for any official making a decision in their case is to doubt their narratives and subject them to disbelief and incredulity. Even in this climate of disbelief, Albanian asylum claims have been singled out for particular hostility. 

Breaking the Chains — a partnership project between the Migrant and Refugee Children’s Legal Unit (MiCLU) at Islington Law Centre and Shpresa Programme — is dedicated to improving outcomes for Albanian children and young people seeking asylum. It has just launched an interim evaluation report presenting key findings from Year 1 of the project.

Call for a Second EU Migration Pact: Revitalizing Rural Communities via Refugee Resettlement!

This week’s European Commission proposal for a “pact on migration and asylum” focuses mostly on stemming irregular migration at EU borders. It thus largely forgets to address Europe’s share in responsibility for the millions of refugees who cannot show up to ask for asylum there. A second "resettlement pact" is therefore urgently required to relieve pressure from countries like Turkey, Lebanon and many others, which currently take care of an unevenly high number of displaced people. Voluntarily relocating more refugees does not have to be a burden for Europe, it can actually create great synergy.

A strong reduction of the share of agriculture in the economy and a lack of viable job alternatives for young people has left many smaller rural European communities depopulating and aging. To establish a new equilibrium, powerful diversification to non-agricultural activities is required. Meanwhile, Internet-based work options and tele-services offer such potential to stop and reverse rural decline, but without a next generation of people grabbing these opportunities, the current deterioration will continue.

Since 2015, Refival has therefore been exploring the synergy between rural revitalization and refugee integration. As a result, it advocates the interconnection of two groups of people: small rural communities of 500–5,000 inhabitants who are too far from urban areas to commute and refugee families with education deficits who will need about 5 years to adapt and find jobs in Europe.

In order to optimize the refugees’ economic mobility, Refival proposes to apply an EU citizen logic. It means that — after having been supported with education, upskilling and cultural integration — people can freely move upon finding employment anywhere in Europe. However, this also implies that investing in the refugees’ adaptation should be collectively funded by all EU member states and not financed by those who supply the initial “incubation” services.

With small rural communities possessing ample cultural interaction capacity and low integration cost, there is a strong mutually beneficial situation to be achieved by receiving funding to welcome refugees and offering them the chance to participate in society. This will not only revitalize the local rural infrastructure for all its inhabitants — reestablishing economic and social sustainability — but also give refugees a new start in life.

De mensen die met bootjes over het Kanaal naar Engeland oversteken blijken "echte vluchtelingen" - Channel boat people are refugees, Home Office officials confirm

"Migrants crossing the English Channel in small boats are overwhelmingly genuine refugees, senior Home Office officials have confirmed. Evidence presented to the Home Affairs committee of MPs on 3 September makes clear that the majority of those making the perilous crossing are either being granted refugee status straight away or come from countries for which the success rate in asylum applications is extremely high.

Figures on small boat crossings are not routinely published, but the Home Office keeps tabs. Senior official Abi Tierney told the committee that 5,000 people have crossed the Channel in small boats so far this year. Of those, 98% have claimed asylum. The Home Office has issued an initial decision on around half of those asylum claims so far.
The breakdown of those roughly 2,500 decisions is as follows:

20% of those have been granted, 10% have been refused and a further 71% have been refused because we are not the responsible country, i.e., they have travelled through a safe country before they came here.

Tierney’s colleague Tyson Hepple, head of Immigration Enforcement, later clarified that the 71% are not being refused in the sense that the Home Office thinks they are not genuine refugees. The department just believes that another European country has the legal responsibility for deciding whether they should be granted asylum or not:

EU negotiators have rejected a British request for a migration pact that would allow the government to return asylum seekers to other European countries.

When the Brexit transition period expires on 31 December, the government will lose the right to transfer refugees and migrants to the EU country in which they arrived, a cornerstone of the European asylum system known as the Dublin regulation.

The government is seeking to replicate the European system outside the bloc, although the Home Office has complained that the EU rules are “rigid, inflexible and abused by migrants and activist lawyers”.

The Guardian has learned that EU member states have ruled out a British plan to recreate the Dublin system outside the EU.

Hundreds of Nigerian Asylum Seekers Missing in Netherlands

AMSTERDAM - A group of investigative reporters says almost half of Nigerian asylum seekers arriving in the Netherlands last year disappeared. It is believed that many fell victim to human traffickers who forced them into prostitution or drug trafficking across the European Union.
A European journalism collective says of the 2,461 Nigerians seeking asylum in the Netherlands in 2019, 961 cannot be located. Another 128 Nigerians who arrived in January of this year also disappeared, according to an investigation by the journalist group Lost in Europe.

Most ‘asylum seeker’ crime is not committed by real refugees fleeing persecution but by people coming from safe countries.


Asylum seekers who have been given official refugee status lose their residency permit if convicted of a crime which carries a six month jail term. In the 3.5 years to June 2019, 90 asylum requests were rejected and 100 refugees lost their residency rights because of a criminal conviction.

General features of the job

• The Policy Officer is responsible for keeping on top of developments and priorities in the broader field of migration (legal and irregular migration, highly skilled migration, refugees, academia, return, humanitarian programmes a.o.)
• The Policy Officer is responsible for co-shaping, giving advice about, designing, implementing and monitoring Dutch policy objectives regarding the above mentioned topics in Jordan.
• The Policy Officer coordinates with other donors, (I)NGOs and UN agencies and represents the Embassy in relevant meetings.
• The Policy Officer remains in close contact with relevant directorates within the Ministry of Foreign Affairs (DSH, DAM, BMB and others) and other relevant ministries in The Hague.
• The Policy Officer assists the Management Team in all tasks relating to these topics.

Duties and result areas

Duties:

• The Policy Officer is the embassy’s focal point and is primarily responsible for policy-issues in the fields of migration and refugees (see under general features). Examples of such issues include local migration policy, refugee resettlement, humanitarian aid, social protection, labour mobility and refugee scholarship schemes.
• He/she writes reports and cables analysing developments related to migration and refugees, and thereby proposing innovative approaches and taking long term perspectives.
• The Policy Officer is responsible for programme management and administering all or parts of the project cycle related to projects in the fields of migration and refugees, depending on the centralised or delegated nature of the Dutch MFA project funds.
• He/she represents the Netherlands in donor coordination- and relevant EU-meetings in Jordan and reports back in writing to relevant colleagues in The Hague, at the embassy, and, if relevant, embassies in the region.
• The Policy Officer will maintain close contact with authorities, embassies, local and international organisations, experts and other relevant stakeholders.
• The Policy Officer reports directly to the Deputy Head of Mission. He/she will keep policy- and project-colleagues horizontally updated in policy-staff meetings.

Result areas:
Policy: Adequate input for Ministry’s policy function

• Keep relevant departments at the Ministries of Foreign Affairs and Justice & Security in The Hague updated on the latest migration- and refugee-related political and other developments, including changes in legislation.
• Provide relevant up-to-date information upon request from the Ministries as well as pro-actively on own initiative.
• Provide input for migration- and refugee-related debates in NL, as well as - upon request from the Ministry - in Jordan.
• Contribute to policy exchange inside and outside the embassy, including by organising related events and missions.

Programmes: Effective and correct implementation of relevant programmes for Jordan

• Provide adequate input to the Ministry for the formulation of migration- and refugee-related programmes and projects.
• Take care of relevant project management per project, by continuously overseeing the projects and assisting in obtaining agreed monitoring & evaluation data (centrally financed projects), or by managing the whole project cycle (projects financed from delegated funds), in cooperation with the Controller and Project Administration Officer.
• Support the programme manager of the PROSPECTS/ Strategic Partnership by providing policy advice and project support for activities in the fields of migration and refugees.

External function: Keeping an adequate network of relevant stakeholders and play an active role therein

• Establish and sustain a wide and instrumental network of contacts with Jordanian authorities, relevant embassies, EU Delegation, (I)NGOs, UN Agencies and experts.
• Pro-actively represent the Netherlands in the relevant donor- and EU coordination-meetings in Jordan, and inform relevant colleagues about outcomes.
• Take part in other relevant meetings, conferences and receptions for further knowledge building and (informal) networking.
• Build a good relationship with implementing partners, while keeping an eye on the required distance between contracting authority and contractor.

Embassy: Contribute actively to wider embassy goals

• Play active role in maintaining the pleasant, safe and healthy working environment within the embassy, i.a. by participating actively in the embassy’s Mission Council, Task Force Team Readiness, Social committee, Green team, organising the yearly embassy outing and Iftar dinner, Whatsapp group for embassy staff, volunteering for Confidence person etc.
• Put aside one’s own tasks as laid down in this job profile to help in the organization of  important incoming missions or embassy-wide events when necessary or to help out a colleague with a heavy workload.
• Maintain a welcoming attitude towards new staff members, including the embassy’s interns, by possibly guiding them and transferring knowledge and experience.

Working environment

The Policy Officer for Migration and Refugees is part of the 12 colleagues-strong Development & Economic resilience Department of the embassy in Amman. The Department is headed by the Deputy Head of Mission, and the Policy Officer is directly accountable to the Deputy Head of Mission. Part of the work of the Policy Officer, especially the political tasks, will be directly with and under content supervision of the Head of Mission. The Project Officer will also work together with the International Liaison Officer of the Immigration and Naturalisation Department within the embassy.
The Embassy of the Kingdom of the Netherlands is located in Abdoun Al Shamali and is constructed under (Dutch) architecture. "Het is prijzenswaardig van Raff om de helden van toen opnieuw in de spotlights te zetten, maar ook wrang. Gezien de bootvluchtelingenproblematiek van nu, en het feit dat er meer dan één miljoen mensen omkwamen tijdens de Ethiopische Burgeroorlog. Die gruwelijke context ontbreekt grotendeels in The Red Sea Diving Resort, omdat de film zich uiteindelijk meer laat omschrijven als een 'onnmogelijke missie' die mogelijk blijkt, een onvervalst avontuur. Dat gebrek aan historisch inzicht is een gemiste kans, in een film die het nu vooral moet hebben van spanning en sensatie.

Nog steeds zorgen over veiligheid terugkeer Syrische asielzoekers

Het is niet veilig voor vluchtelingen om terug te gaan naar Syrië, als ze hebben samengewerkt met de oppositie. Dat staat in een rapport van het Nederlandse ministerie van Buitenlandse Zaken over de veiligheidssituatie in Syrië.

"Politieke opposanten kunnen het slachtoffer worden van verdwijningen, willekeurige arrestaties en detentie, martelingen en andere mensenrechtenschendingen", schrijven de opstellers van het rapport. Ook lopen mannen en jonge jongens het risico dat ze het leger in moeten. Dat geldt voor alle regio's in Syrië.

Het rapport is van belang voor het asielbeleid van Nederland. Op basis ervan bepaalt staatssecretaris Broekers-Knol of Syrische vluchtelingen teruggestuurd worden.

Acht jaar conflictgebied

Meer dan 13 miljoen mensen zijn binnen en buiten Syrië op de vlucht, voor de nu meer dan acht jaar durende oorlog in het land. Op dit moment is het geweld verminderd. President Assad heeft inmiddels weer de controle over het zuiden en midden van Syrië.

Vooral in buurlanden ervaren gevluchte Syriërs nu druk om terug te keren. Maar volgens het ambtsbericht is er weinig bekend over de omstandigheden op plaatsen waarheen ontheemden terugkeren. Wel wordt geconstateerd dat Syriërs die naar Turkije waren gevlucht tijdens de afgelopen ramadan de situatie thuis gingen opnemen. Maar ze gingen bijna allemaal spoorslags terug naar Turkije.

Nu de Syrische regering steeds meer gebieden onder controle heeft, is er steeds minder informatie beschikbaar, is de conclusie. Achtergebleven familieleden durven nauwelijks te communiceren met familie en vrienden.

Militaire dienstplicht

Redenen die vluchtelingen geven om niet terug te keren, zijn zorgen over schade aan hun huis en gebrek aan geld voor het herstel daarvan. Verder zijn er geen banen en vrezen ze voor de militaire dienstplicht.

Syriërs die wel willen terugkeren, moeten een aanvraag indienen bij de Syrische ambassade in het land waar ze verblijven. Daar wordt gevraagd waarom ze uit Syrië zijn vertrokken, wat ze in het gastland hebben gedaan, en welke inkomsten ze hebben gehad.

Volgens de Syrische onafhankelijke mensenrechtenorganisatie SOHR, een van de bronnen van Buitenlandse Zaken, krijgen mensen die niet hebben samengewerkt met de oppositie geen problemen bij hun terugkeer. Zij kunnen hun papieren regelen door veiligheidsdiensten om te kopen.

Namenlijsten

Syriërs die overwegen terug te keren, laten bekenden in Syrië nagaan of zij op een lijst van gezochte personen staan. Eerder deden op internet lijsten de ronde met daarop namen van mensen die door de Syrische autoriteiten worden gezocht. Die lijsten zijn nu verdwenen, constateren de onderzoekers.

Vluchtelingenwerk Nederland ziet in het rapport aanleiding om voorlopig geen Syriërs terug te sturen. In de Tweede Kamer gingen de laatste maanden stemmen op om dat wel te doen, nu het rustiger wordt in dat land.

In which ways can these stories be presented to a broader audiences? Why is cultural participation of refugees important? These are the central questions of the Oracle of Amsterdam, a sharing and inspiring closure of the European project Specially Unknown. At the closing plenary the participants will find themselves again in the temporary oracle space, where the scenarios created during the workshops will be brought together and presented.

They will form a basis for a brief discussion: several ideas from the presented scenarios will be selected and the participants will be invited to react and give their opinions about them.

Ruth Webber’s PhD research explored the meaning and importance of ‘home’ to migrants, refugees and asylum seekers living in Glasgow, with a particular focus on the impact of hostile environment policies and legal status. This workshop presents findings from her research and will foster a reflective space, asking: “What are the barriers faced by cultural institutions to supporting the participation of those living under the hostile environment, and what can cultural institutions do to develop their inclusive practices in this field?”.

EU has paid out more than €2 billion (2.3 billion) to support refugees and host communities in Turkey, according to the third annual report of EU Facility for Refugees in Turkey.

According to the report, some 1.5 million refugees were reached through monthly cash transfer for their basic needs, 470,000 children attended school and over 5 million primary healthcare consultations delivered.
The EU Facility for Refugees in Turkey was set up in 2015 in response to the EU Council’s call for additional funding to support Syrian refugees in Turkey.
The facility mainly focuses on humanitarian assistance, education, health, municipal infrastructure, and socioeconomic support.
Turkey currently hosts almost 4 million registered refugees -- out of which nearly 3.6 million are Syrians.

Internal dIsplacement and the global compact on refugees Are today’s returning refugees tomorrow’s IDPs?

More than 550,000 refugees made the arduous journey back to  their  countries  of  origin  in  2016,  mainly  to  Afghanistan,  Somalia  and  Sudan.  For  many  returnees,  however,  repatriation  carries  the  risk  of  de  facto  internal  displacement  (if  they are unable to go back to their place of origin or sustainably integrate elsewhere) or secondary displacement (if they are forced to uproot their lives again). This demands a more holistic approach to durable solutions that integrates planning and policy for internally displaced people (IDPs) with that for returning refugees to mitigate the risk of people being caught up in secondary, multiple or pendular movements.

Boek: Refugees, Terror and Other Troubles with the Neighbors: Against the Double Blackmail

Called "the Elvis of cultural theory" by The New York Times, popular philosopher and leftist rabble-rouser Slavoj Zizek, looks at one of the most desperate situations of our time: the current refugee crisis overwhelming Europe.

In this short yet stirring book, Zizek argues that accepting all comers or blocking all entry are both untenable solutions... but there is a third option.

Today, hundreds of thousands of people, desperate to escape war, violence and poverty, are crossing the Mediterranean to seek refuge in Europe. Both solutions are bad, states Zizek. They merely prolong the problem, rather than tackling it.

The refugee crisis also presents an opportunity, a unique chance for Europe to redefine itself: but, if we are to do so, we have to start raising unpleasant and difficult questions. We must also acknowledge that large migrations are our future: only then can we commit to a carefully prepared process of change, one founded not on a community that see the excluded as a threat, but one that takes as its basis the shared substance of our social being.

The only way, in other words, to get to the heart of one of the greatest issues confronting Europe today is to insist on the global solidarity of the exploited and oppressed. Maybe such solidarity is a utopia. But, warns Zizek, if we don't engage in it, then we are really lost. And we will deserve to be lost.

Asylos is a pan-European network of volunteers researching information for asylum claims.

The Asylos network’s volunteer researchers work to ensure that every asylum seeker has a fair opportunity to claim his or her right to protection. Evidence to prove persecution or to support the credibility of an individual testimony is a vital element in decisions taken to grant or withhold asylum. Still, many refugees and their legal representatives cannot access this information. As a result, our legal system fails to protect them.

To redress this imbalance and protect the right to asylum we work to:

• ensure that asylum seekers and their legal counsel have access to crucial sources and data to substantiate their claim

We believe that refugees and their counsel should have equal access to information and sufficient resources to conduct the needed research. Those helping to defend asylum seekers’ rights face great difficulties when researching information: it often requires understanding local languages and experience in researching complex human rights issues, as well as access to expert evidence in the countries of origin. However, asylum procedures, which have been drastically shortened in many European countries, and limited legal aid budgets don’t allow resources or time for sufficient research.

• ensure that the asylum procedure is evidence-based and unbiased

We believe that decisions on individual claims should be fair and based on proper evidence instead of pre-conceived notions. Country-of-origin information reports produced by public administrations should meet the highest standards of our legal system and be driven by respect for human rights. Information compiled by public authorities should be accessible to the public. Asylum courts should rule based on the best available evidence and data. Officials with decision-making power regarding asylum claims should have received sufficient training to be able to make evidence-based decisions.  They need to be aware of the latest developments in the countries of origin of the asylum seekers.

How we work

To access very detailed information from remote areas, and often from conflict zones, we use investigative research techniques. Collectively, Asylos’s volunteers can conduct research in more than 20 languages. After consulting relevant publications from human rights NGOs, governments, international organisations and international and local media, we can fill information gaps by conducting interviews with experts, such as NGO professionals in the countries of origin, academics, or journalists. In addition, we leverage online tools and social media for obtaining evidence for asylum claims: for example, we can use social network analysis to obtain information about events or people, satellite imagery analysis to prove the existence of specific places, and domain registration records to identify website owners.
In addition to using existing datasets, we’ve built internal search engines to more effectively search sources we trust, including sources in local languages, and to categorise and share information through bookmarking services.

Researching case-specific information
Our research is free of charge and conducted at the request of asylum lawyers and NGOs assisting asylum seekers with their claims. Our reports detail human rights violations in specific countries or investigate specific facts relating to the claimant’s testimony.

Producing new sources
In addition to our case-specific work, we collaborate with other NGOs to produce new sources to fill gaps in country-of-origin information.

Promoting better procedures
We also gather data about the use and impact of evidence in asylum courts. Learning what works in court enables us to advocate for better procedures and fairer decision making on asylum claims.

Our impact

During the past six years, we have produced nearly 300 research notes and helped many individuals claim their right to asylum. Lawyers tell us that they would not have had the resources to conduct thorough country-of-origin information research without our help. Our research notes are quoted in court decisions and have been used by UNHCR to inform UN eligibility guidelines. Through our research we have helped counter misinformation and stereotypes in asylum courts and administrations.
