In deze uitspraak krijgt de IND een enorme uitbrander - stoïcijns niet reageren op herhaalde verzoeken van de rechtbank om een standpunt in te nemen, zeer laakbaar.

Op grond van artikel 8:81 van de Awb kan indien tegen een besluit bij de bestuursrechter beroep is ingesteld, de voorzieningenrechter van de bestuursrechter die bevoegd is in de hoofdzaak, op verzoek een voorlopige voorziening treffen indien onverwijlde spoed, gelet op de betrokken belangen, dat vereist. 2. Aan het verzoek om een ordemaatregel heeft verzoeker ten grondslag gelegd dat de procedure die voorligt al lange tijd loopt. Een eerder beroep is gegrond verklaard en weer komt verweerder met een voor verzoeker nadelig besluit. Als gevolg van dit besluit mag verzoeker (weer) niet werken, en rust op hem een vertrekverplichting. Met het verzoek om een ordemaatregel beoogt verzoeker de mogelijk opnieuw lange duur van zijn procedure en de daarmee gepaard gaande negatieve gevolgen die dit voor hem zal hebben, te voorkomen en zijn woning en werk te behouden zolang de procedure duurt.   Why is the Commission issuing new guidance? In response to the coronavirus pandemic, the EU has put in place a restriction on non-essential travel to the EU mid-March 2020. The Commission set out categories of persons that should not be covered by these restrictions. Following a Commission proposal, the Council adopted on 30 June 2020 a recommendation on the gradual lifting of the temporary restrictions on non-essential travel into the EU, including an initial list of countries for which member states should start lifting the travel restrictions at the external borders. This book provides a comprehensive assessment of the effectiveness of Mobility Partnerships and their consequences for third countries. Mobility partnerships between the EU and third countries are usually viewed as reflecting asymmetric power relations where development aid, trade relations and visa policies are made conditional upon the cooperation by third countries with an EU agenda of migration control. " Vandaag kreeg ik van de Raad van State na 15 maanden wachten de uitspraak terug over een veel voorkomend probleem: heeft een derdelandse ouder die elders in de Unie een (mogelijk) verblijfsrecht heeft, het recht om bij het Nederlandse kind ín Nederland te verblijven? De IND werpt dit zogenaamde "verblijfsalternatief binnen de Unie" tegen omdat het kind dan (theoretisch) de Unie niet hoeft te verlaten. Maar dat verblijfsrecht elders is juridisch niet zeker. En verder hebben deze kinderen ook een Nederlandse vader waar ze al jaren mee in het gezin wonen. Mag je dan een Nederlands kind dwingen te emigreren en vervolgens vader nauwelijks meer te zien?
