  #Afghanistan country information repository Asylos, ARC Foundation and Clifford Chance have put together a country information package to help support Afghan asylum claims. It is a collection of media, United Nations and NGO reports on all sorts of human rights issues, from the application of Sharia law to attacks on disability activists. It is also bang up to date, with a new edition every Thursday for the time being.  The document is not something to throw into an asylum case in its entirety. Asylum seekers and their lawyers should go through it to pick out relevant evidence and submit that as part of the claim. Anyone who has done so already and has feedback is being invited to join a one-hour focus group. Briefing: how Brexit leaves refugee families stranded in Greece

Since 1 January 2021 people seeking asylum in Europe, be they adults or children, have been far less likely to reunite with their family in the UK. A vital legal route has been closed, as the Brexit transition period has come to end and the Dublin III Regulation can no longer be relied upon. In the UK, the family reunification provisions of Dublin III were little known even to immigration lawyers. Given the UK’s geographical location, Dublin III was most commonly utilised to push people back to fingerprints as opposed to forwards to family. UK judge halts whole deportation flight to Spain

A senior high court judge has halted a charter flight hours before up to 20 asylum seekers who crossed the Channel to the UK in small boats were due to be forcibly removed to Spain, a country they had previously passed through. The judge, Sir Duncan Ouseley, ordered the flight to be grounded because of concerns that the asylum seekers due to fly might be left destitute in the streets of Madrid, as happened to another group earlier this month. It is thought to be only the second time an entire Home Office charter flight has been grounded by a high court action. While people have to work within a legal framework the person who interviews or decides has a certain freedom and people also work differently. "On the third day of the asylum procedure, the asylum seeker will be given the opportunity to explain why he fled from his country of origin. [1] During the interview, his asylum motives will therefore take centre stage. An interpreter will be present during this interview, and a volunteer from the Netherlands Refugee Network or the asylum seeker’s lawyer may be present, but often is not. Two important (but completely different) points arise from the Upper Tribunal’s decision in MH (review; slip rule; church witnesses) Iran [2020] UKUT 125 (IAC) , one concerning religious conversion cases and the other concerning clerical errors in a written decision. “Expert” evidence on religious conversion The first is quite a significant watering down of the Court of Session’s decision in TF and MA v Secretary of State for the Home Department [2018] CSIH 58 , one of the few important immigration decisions to be decided north of the border. That case opened the door to fellow church-goers giving “expert evidence” on an asylum seeker’s conversion to a religion that would see them persecuted if returned to their country of origin. On this point, the Upper Tribunal differed from the Court of Session. Asylum seekers who have been given official refugee status lose their residency permit if convicted of a crime which carries a six month jail term. In the 3.5 years to June 2019, 90 asylum requests were rejected and 100 refugees lost their residency rights because of a criminal conviction. Those Human traffickers must be drooling: the UK will leave the Dublin Agreement

As of 2021 the UK will not be part of the Dublin Agreement anymore while still being a memberstate of the Refugee Convention and the ECHR. So when you are rejected on the continent and you try in England you will not be send back to say Italy. Unfortunately that will bring drowned people to our shores and criminals to our ports.
