EU rejects British plan for post-Brexit return of asylum seekers

300 people turned down by EU Settlement Scheme

The EU Settlement Scheme statistics for February 2020 are out. They show 300 refusals. We’re told by the Home Office that the increase is mainly due to refusals for eligibility, not over criminality. The two core reasons, the Home Office says, for the jump in refusals are: Failing to provide eligibility evidence, either at the application stage or in reply to requests from the Home Office Caseworkers. Non-EEA/Swiss family members failing to evidence their relationship to the EEA/Swiss sponsor. This could include failing to provide a marriage certificate or not possessing the relevant document as a dependent relative. Het Britse standpunt over het vrij verkeer van personen binnen de EU en Brexit (EU citizens arriving in the UK during the implementation period )

1) The UK and the EU are currently negotiating the terms of an implementation period to commence after our withdrawal from the EU. The purpose of such a period is to give people, businesses, and public services in the UK and across the EU the time they need to put in place the new arrangements that will be required to adjust to our future partnership. 2) As part of these negotiations, the EU has proposed that the provisions on citizens’ rights in the Withdrawal Agreement should apply as of the end of the implementation period. Given the UK will leave the EU on 29 March 2019, and become a third country, we do not believe this is the right approach. The expectations of EU citizens arriving in the UK after our exit will not be the same as those who moved here before our withdrawal, and the same will be true of UK nationals moving to an EU Member State. For example, in Dimitry Kochenov ’s excellent new book EU Citizenship and Federalism: The Role of Rights , Loïc Azoulai advances a formidable analysis by exposing the dichotomy between “good citizen” cases such as Carpenter ( C-60/00 ) and Zambrano ( C-34/09 ) and “bad citizen” cases such as P.I. ( C-348/09 ) who sexually abused his partner’s daughter and M.G. ( C-400/12 ) who was convicted of child abuse. Mensensmokkel: Gangs smuggling Vietnamese kids from Calais to UK for work on cannabis farms - NSPCC

Members of the charity’s Child Trafficking Advice Centre (CTAC) spent a week in France training volunteers in how to identify vulnerable children. They found young people are being illegally transported hundreds or even thousands of miles across the world by smugglers, frequently exposing them to horrifying physical and sexual abuse. Children as young as nine living in the camp could be vulnerable to traffickers, the charity warned. Vietnamese children are especially prevalent in the camp. Statement: the status of EU nationals in the UK

There has been no change to the rights and status of EU nationals in the UK, and UK nationals in the EU, as a result of the referendum. The decision about when to trigger Article 50 and start the formal process of leaving the EU will be for the new Prime Minister. The UK remains a member of the EU throughout this process, and until Article 50 negotiations have concluded. When we do leave the EU, we fully expect that the legal status of EU nationals living in the UK, and that of UK nationals in EU member states, will be properly protected. The government recognises and values the important contribution made by EU and other non-UK citizens who work, study and live in the UK. I have lived in the UK for more than 5 years. That much is simple – Article 20 TFEU doesn’t leave any doubt that Union citizens are those who are citizens of the Member States. Still, while that provision was once thought to make Union citizenship dependent on national citizenship, in Rottmann the Court turned it neatly around, showing how it made national citizenship equally dependent on EU law. In that case a German citizen was faced with threatened denaturalisation, which would be likely to leave him stateless. He argued that the denaturalisation, because it also deprived him of his Union citizenship, was an interference with his EU law rights, and so should be constrained by EU law. As a consequence, statelessness has emerged as one of the central political issues in relation to the collapse and weakening of the states in the Middle East. Through deploying a qualitative inquiry and interviews with 50 Kurdish immigrants, this article investigates how members of Kurdish diasporas in Sweden and the UK conceive and experience statelessness in a world of unequal nation-states and hierarchical citizenship. Since diasporas are important non-state actors in nation-building processes, it is important to analyse their diasporic visions and the ways they challenge or reinforce the power of the nation-state in the context of migration. Refugee crisis: Afghanistan ruled safe enough to deport asylum-seekers from UK

Hundreds of failed asylum-seekers, including former child migrants, are to be sent back to Afghanistan after the Court of Appeal ruled that deportations can be resumed. A blanket ban on deportations back to the war-ravaged country was imposed in August last year amid concerns that it was too dangerous. Swathes of territory are controlled by the Taliban, and Isis is establishing a foothold. But Home Secretary Theresa May won a significant legal battle to restart the flights – even though last year was the bloodiest on record for civilian casualties in the country. Discussieonderwerp: Asielaanvraag op legerbasis. Domme keuze van asielzoekers of foute interpretatie van Verdrag door Engeland?

CASUS: Koerden komen op hun vlucht 17 jaar geleden aan op Cyprus en vragen asiel aan Groot-Brittanie op een Britse legerbasis. Ze willen naar Engeland. Engeland erkent geen asielaanvragen op legerbasissen want die willen ze niet zien overstromen met asielzoekers. Koerden vragen geen asiel aan op Cyprus omdat ze van mening zijn dat hun kans op werk daar nihil is. Met als gevolg dat ze al 17 jaar in een hutje op de basis wonen met 75 personen. Wat vindt U?  Mag zowel juridische uitleg als niet juridische mening zijn. Ik hou de mijne nog even voor me.
