Piraterij en 1F (deel 2)

Piraterij is nog steeds iets wat in het internationaal gewoonterecht wordt behandeld.

Shaw zegt in "International law" pagina 321, 1986 "Any and every state may seize a pirate ship or aircraft wheter on the high seas or on terra nullius and arrest the persons and seize the property on board. In addition the courts of the state carrying out the seizure have juristdiction to i,mpose penalties and may decide what action to take...... The fact that every state may arrest and try persons accused of piracy makes that crime quite exceptional in international law where so much emphasis is placed upon the sovereignity and jurisdiction of each particular state within its own territory.

Piraterij wordt omschreven in artikel 15 van de High Sea convention.

In het persbericht van de uitspraak staat ook: "De rechtsmacht vloeit voort uit de in het Wetboek van Strafrecht gevestigde universele rechtsmacht voor gevallen van piraterij op de volle zee waar ook ter wereld door wie dan ook gepleegd, welke regeling aansluit bij daartoe strekkende verdragen.".


Dus ook sub B van artikel 1F kan volgens mij worden gebruikt om deze Somalische piraten asiel te weigeren.

Maar ik denk dat ook sub A mogenlijk gebruikt kan worden:

Wij Nederlanders hebben de neiging om bij sub A aan grote boeven als Karadjic en Saddam Hoesein te denken maar in de Britse jurisprudentie worden daar ook de meelopers onder geschaard.

Als we kijken naar SK ( ZIMBABWE ) Appellant / Claimant - and - SECRETARY OF STATE FOR THE HOME DEPARTMENT, [2012] EWCA Civ 807 http://www.bailii.org/ew/cases/EWCA/Civ/2012/807.html dan hangen de heren volgens mij ook op dit punt.

De rechters overwegen daar in r.o 61
In sum, in my judgment, the critical feature of the requirement of "similar character" is that "other inhumane acts" should be, by their nature and the gravity of their consequences, of comparable ("similar") character to the other enumerated crimes. They plainly do not, otherwise, have to share the elements of those other crimes. If they did have to do so, they could not be "other" inhumane acts, as the ICC emphasised in Katanga. The critical epithet in any event is "similar", not "identical" or "same". As violence goes, other inhumane acts will necessarily fall short of killing, for that is a separately listed crime under the title of "murder". However, it is clearly contemplated that violence short of killing or an intention to kill may fall within article 7(1)(k), as demonstrated by the citations above (and see, for instance, Robinson's reference to "particularly violent assaults" cited at para 49 above, which seems to me to fit well with the findings in this case). Similarly, these citations demonstrate that it is contemplated that violence may lead to serious consequences other than bodily injury, consequences such as "great suffering" or injury to "health", mental or physical, as indeed the text of the sub-paragraph (k) itself reveals. What constitutes "other inhumane acts" of similar character is, of course, a matter of evidence, but also for judgment, and may depend on all the circumstances of the case. Indeed, the requirement of sufficient seriousness is the inescapable lesson of almost every aspect of the definition in question, and all these aspects tend to merge into one another in emphasising the necessity for sufficient seriousness. Thus, the chapeau requirement itself will necessarily underline the gravity of the crime (as ICTY explained in Tadic). Similarly, the requirement of "great suffering" (etc) makes its own demands. And the need for "similar character" likewise enforces or re-inforces in its own way the requirement of comparability across the enumerated crimes. The crime must have, in its context, its intention, and/or in its consequences, an aspect which goes beyond the nature of merely domestic crime, however shocking (as it may be), and calls for international sanctions. 


Lees hiervoor vooral de lange en uitgebreide uitspraak waarin de rechters hun betoog helemaal onderbouwen en tot de conclusie komen dat iemand in een knokploeg ook hier onder kan vallen. Britten schrijven zulke mooie uitspraken vergeleken bij de meer ontoegankelijkere Nederlandse. Maar de uitspraak is te lang om hier op te nemen omdat anders mijn weblog vastloopt.

Dan rest nog de vraag "wat als ze asiel kan worden geweigerd volgens het Vluchtelingenverdrag staat artikel 3 EVRM dan geen uitzetting in de weg?" Die vraag is in het verleden bijvoorbeeld aan de orde gekomen in het Sison III arrest 

Maar hier is wel een speciaal iets aan de hand wat bij een normale asielaanvraag niet speelt. Komt normaal iemand naar Nederland en vraagt asiel aan, hier zijn mensen op volle zee uit hun boot geplukt. Volle zee is "res nullius" oftewel van alle mensen en valt niet onder een land. Zou Nederland ze niet gewoon in een zelfde bootje op dezelfde plek in zee kunnen terugzetten?

Dit is trouwens het boek van Shaw dat ik gebruikte. Een feest om te lezen. Het behandelt van alles: van territoriale wateren, jurisdictie, verdragenrecht maar ook mensenrechten. En op zo'n manier dat je het leest omdat het leuk is om te lezen! Aanrader dus.

In verband met geldwolven die denken geld te kunnen claimen op krantenartikelen die op een blog als deze worden geplaatst maar na meestal een dag voor de krantenlezers aan leeswaardigheid hebben ingeboet terwijl wij vreemdelingenrecht specialisten ze soms wel nog jaren gebruiken om er een kopie van te maken voor een zaak ga ik over tot het plaatsen van alleen het eerste stukje. Ja ik weet het: de kans dat u doorklikt is geringer dan wanneer het hele artikel hier staat en een kopie van het orgineel maken handig kan zijn voor uw zaak. Wilt u zelf wat overnemen van dit weblog. Dat mag. Zet er alleen even een link bij naar het desbetreffende artikel zodat mensen niet alleen dat wat u knipt en plakt kunnen lezen maar dat ook kunnen doen in de context.
