Leiden, my city Leiden is a beautiful, fun and thriving city. There’s a good atmosphere (or as we say in Dutch – gezellig), a historic centre and a friendly population. Why it is wise to register as a non-EU partner of a foreign EU-resident living in The Netherlands (And British due to BREXIT)

Big tears slowly dropped down. She had come to The Netherlands with her EU boyfriend and he had said she did not need a residence permit. She was not having a job but kept the household spot and span. All finances were taking care of by her boyfriend. But then after many years the relationship ended and she applied for her own residence permit. "Can you prove you have been living in the Netherlands as a common law wife of an EU resident for at least 5 years?" asked the Dutch Immigration Service IND. And with a boyfriend who had done all the paperwork, who had not seen the need to register at the municipality or at the IND that turned out to be bloody difficult. Do you need to register at the IND to be legal in The Netherlands when you are a wife, husband, boyfriend or girlfriend of someone from another EU country?  No you do not. Under Regulation 2004/38/eu a foreign spouse, husband or registered partner has a direct right to stay in the EU country his or her EU lover has...

"Life, love and Law in the Lowlands " Date: Thursday November 17th,, 2016

You are an expat and living in The Netherlands? Have you settled? Can you adjust to Dutch culture and way of living? Do you live here with your family? Does everyone respond to his or her new environment in the same way? If you came here as a single, chances are you meet your significant other or already have, and want to make the next step. Move in together, or get married! And what happens when you have a child? Are you aware of the legal consequences these steps bring about, or when you break up? What happens then? All complicated matters and even more when you live abroad. As family lawyers we often get introduced with people, young families, when trouble starts. However, we would like to raise awareness of parts of Dutch family law upfront, and prevent troubles afterwards. For example, what are the legal consequences of: • buying a house • having a child • getting married • breaking up or divorce And what if you can’t settle in The Netherlands? Or if there is tension between...

Orange book on Dutch visa refusals / Oranje boek over visum weigeringen

A few weeks ago I wrote to the Director of the Dutch Immigration Service (IND) that I was contacted by so many people who had seen their visa request denied and in all those cases on grounds that were incomprehensible. People who: had been to The Netherlands for business before and now were not allowed, are hardworking bankers or software consultants who suddenly were told they were refused because another country regarded them a danger for national security (can you imagine how a boss then looks at his employee) while they had travelled the world, never overstayed, never asked asylum, had no criminal record nor bad friends or family. had been to The Netherlands to visit family and had always returned home in time had to attend or visit trade fairs and had all the paperwork submitted and spent already a lot of money and then get refused. were quite well to do and just wanted to take a holiday. For us as a country tourism and trade are major sources of income. A tour...

Council of State tears up fines for ‘illegal Macedonian workers’ / Raad van State uitspraak

Social affairs minister  was wrong to fine five companies for using foreign workers to build a  railway bridge over the IJssel river, the Council of State said on  Wednesday.  Rail operator ProRail, two Dutch companies, a German firm and one from  Macedonia were each fined €552,000 after inspectors found 62 workers  from Macedonia and Bulgaria working on the project in 2009 and 2010.  The social affairs ministry argued the men were employed by the  Macedonian firm and should have had a work permit to be employed on  projects in the Netherlands.  The companies, however, insisted the men were employed via the German  firm and did not therefore need a work permit. The Council of State on  Wednesday agreed with the reasoning and said the minister had not proved  they were employed by the Macedonian company.  In addition, the workers had German residency permits which allowed them  to travel and work throughout the Eu...

Ko’nki-klapy: Dutch words which have been adopted abroad (gewoon omdat het zo'n leuk artikel is)

No fewer than 17,560 Dutch words have been incorporated into 138 languages around the globe, according to researchers at the Meertens Institute. The report is the result of an eight-year research project. Russian, for example, has lots of Dutch nautical words, while Japanese goes for scientific terms. Trade and immigration played their part, and so does the Netherlands’ colonial past: Indonesian is replete with Dutch words. Here’s one word for every letter in the alphabet.
