Briefing: how Brexit leaves refugee families stranded in Greece

Afbeelding
Since 1 January 2021 people seeking asylum in Europe, be they adults or children, have been far less likely to reunite with their family in the UK. A vital legal route has been closed, as the Brexit transition period has come to end and the Dublin III Regulation can no longer be relied upon. In the UK, the family reunification provisions of Dublin III were little known even to immigration lawyers. Given the UK’s geographical location, Dublin III was most commonly utilised to push people back to fingerprints as opposed to forwards to family. The article explains what the end of Dublin III means for asylum seekers trying to join family in the UK.

It just got even more difficult for EU nationals to get British citizenship

On 30 September 2020 the Home Office updated its good character policy for naturalisation to make it even harder for EU nationals to become British citizens.  The new policy doubles the period of time, from five years to ten years, during which certain EU citizens in the UK must have held comprehensive sickness insurance (CSI) or a European health insurance card (EHIC) issued by an EU country, in order to qualify for citizenship. The Home Office had recently updated a different nationality policy along similar lines. It has evidently decided to double down despite the controversy provoked by the previous change.  Continue here: https://www.freemovement.org.uk/it-just-got-even-more-difficult-for-eu-nationals-to-get-british-citizenship/?utm_source=rss&utm_medium=rss&utm_campaign=it-just-got-even-more-difficult-for-eu-nationals-to-get-british-citizenship&utm_source=Free+Movement&utm_campaign=b38dc38b40-Daily+emails+everything&utm_medium=email&utm_t...

British companies opening a Dutch branch in case there will be a hard BREXIT. What about employees after that happens?

Afbeelding
In one of the Dutch newspapers an article on British companies opening a Dutch branch in case there will be a hard Brexit. That way they will still have access to free trade within the EU markets. Are you wondering how to enable British employees and other non-EU personnel to work in The Netherlands during a searchyear (minimum wages), after a searchyear (3 years for a minimum of around 2500 euro a month), as a knowledgemigrant (two sets of wages requirements) feel free to contact me during the week.   The interesting article you can find in Dagblad van het Noorden 26th of September 2020.

Defence for Children klom in de pen.

Lees het artikel op het Free movement blog: Whilst EU citizens who arrive in the UK before exit day appear to have their rights to stay and to access basic services protected, there is very little protection for them contained in primary legislation. Much of what is said about their rights is contained in secondary legislation, also known as statutory instruments, that can easily be altered by further primary or secondary legislation.  Of greater concern is that much of what is recorded about EU citizens’ rights is found not in primary or even secondary legislation but in government policy documents and explanatory notes. These may well reflect the government’s current intentions on the rights of EU citizens but they do not provide a lot of certainty as to future arrangements.  Hier staat de rest: https://www.freemovement.org.uk/what-legal-rights-will-eu-citizens-have-after-a-no-deal-brexit/ Interessant artikel? The practical implications of a no-deal Brexit for British citizens travelling to the EU

I can recommend this article from Free Movement: Free Movement:The practical implications of a no-deal Brexit for British citizens travelling to the EU https://www.freemovement.org.uk/the-practical-implications-of-a-no-deal-brexit-for-british-citizens-travelling-to-the-eu/ However I discovered two mistakes: According to the writer in case a visa will be required, business people would not be able to work in a Schengenstate while visiting. " If the EU were to impose visas, even if only for short stays, UK business visitors would be among the most affected. The limited period of stay (in many cases as short as five days), the restricted scope of permitted activities, and in particular the frequent need to apply for a visa will cause many British business travellers considerable trouble. A business short-stay visa does not permit one to remain in the Schengen area for more than three months, to establish a business, trade or profession, to make business deals, to recr...

Important information for British people living in The Netherlands

Both articles I copied from the governmental website of the IND. Make sure however that you are registered at your local Gemeentehuis and at the IND because to give you leave to remain the Dutch government has to know you were here before the UK left the EU. Right of residence transition scheme for British citizens in the Netherlands January 8, 2019 The Dutch government has decided that, in the event of a no-deal Brexit, British citizens and their families who are lawfully resident in the Netherlands prior to 29 March will be entitled to live, work and study in the Netherlands for at least another 15 months. This transition scheme will also apply to family members of British citizens who do not hold EU citizenship themselves. During this 15-month period, the Dutch Immigration and Naturalisation Service (IND) will...

Even on my blog it is obvious how BREXIT worries people in Ireland

Afbeelding
With mrs May's failing solution to a marginal vote to leave the EU people start to worry what will happen in two months time. Here in The Netherlands we did not even research how much of our imports comes from the UK but the government did train extra border personnel. When I speak to my Scottish friends it seems that chaos is expected there. They do not dare to be on holiday when the UK leaves the EU. One look at the pageviews of this week on my blog - a very quiet week because I did not post new posts - shows the amount of Irish readers that is quite exceptional for a Dutch website. Even with posts on BREXIT.   Interessant artikel? UK citizens as non-EU citizens in the EU after Brexit: applying the EU Directive on non-EU long-term residents

Professor Steve Peers , University of Essex* Introduction What happens to UK citizens in the EU27 after Brexit, if they have been living in an EU27 country for some time? If the proposed withdrawal agreement is ratified, they will retain most of their current rights under EU free movement law in the country they live in, although without the right to move freely between Member States any longer. (There will also be a transition period during which UK citizens could still enjoy free movement rights to the EU27, and vice versa). EU27 citizens in the UK will equally retain current rights (for a detailed annotation of an earlier version of the citizens’ rights provisions in the agreement, which do not differ much from the final version, see my blog post ). If the withdrawal agreement is not ratified, there is apparently no intention on the part of the Commission to propose an EU-wide law to protect UK citizens’ acquired rights (as I suggested here ). So, as the Commission ...

Why it is wise to register as a non-EU partner of a foreign EU-resident living in The Netherlands (And British due to BREXIT)

Big tears slowly dropped down. She had come to The Netherlands with her EU boyfriend and he had said she did not need a residence permit. She was not having a job but kept the household spot and span. All finances were taking care of by her boyfriend. But then after many years the relationship ended and she applied for her own residence permit. "Can you prove you have been living in the Netherlands as a common law wife of an EU resident for at least 5 years?" asked the Dutch Immigration Service IND. And with a boyfriend who had done all the paperwork, who had not seen the need to register at the municipality or at the IND that turned out to be bloody difficult. Do you need to register at the IND to be legal in The Netherlands when you are a wife, husband, boyfriend or girlfriend of someone from another EU country?  No you do not. Under Regulation 2004/38/eu a foreign spouse, husband or registered partner has a direct right to stay in the EU country his or her EU lover has...
