  I wanna call my lawyer , hoor je vaak zeggen in Amerikaanse films en Engelse KRO- detectives. En in de ondertiteling staat dan ‘advocaat’ voor lawyer. Strikt genomen is dit niet écht het goede woord. Tot misverstanden zal het niet leiden, want ook in het Verenigd Koninkrijk en in de Verenigde Staten hebben mensen het over hun lawyer als ze de persoon bedoelen die hen bij moet staan in een gerechtelijke procedure. Maar als je als Nederlandse advocaat lawyer op de Engelstalige versie van je visitekaartje zet, doe je jezelf toch tekort. Een lawyer is een jurist (ofwel iemand met een juridische opleiding), en dit woord is dus niet de juiste aanduiding voor een advocaat. Het Engelse woord advocate is alleen in Schotland (zie onder) een goede vertaling voor de Nederlandse ‘advocaat’. Every asylumseeker is given a lawyer without having to pay for that lawyer. This has been standing practice for many many years in The Netherlands predating the Proceduredirective. Recently someone mailed me from abroad and said he had the feeling the local staff at t he Dutch embassy was only giving out visa to people they knew. What to do? What might be an option is to file a complaint at the Dutch Immigration Service about this practice. One can do so by sending a complaint to: Immigration and Naturalisation Service, P.O. Box 10, 7600 AA ALMELO,The Netherlands by using this form: https://ind.nl/Documents/Complaints_form.pdf But can it not be the case that someone keeps submitting visa-requests that have a hidden fault? That is why another possibility (and I think one one should try first) is to appeal against the refusal. That might do the trick. The thing is visa can be denied for several reasons. Case is as follows. Guy is in detention in Belgium and will be deported afterwards to his African land of origin. But he has a wife and kids in Greece and had a permit to stay there in the past. A judgement is expected early next month in a freedom of religion case brought by an Italian lawyer who complains that he was forced to work on Jewish holy days. The applicant, Francesco Sessa, is an Italian national who was born in 1955 and lives in Naples (Italy). He is a member of the Jewish faith and a lawyer by profession. In his capacity as representative of one of the complainants in a case, he appeared before the Forli investigating judge at a hearing concerning the production of evidence. As the judge was prevented from sitting, his replacement invited the parties to choose between two dates for the adjourned hearing. The applicant pointed out that both dates corresponded to Jewish religious festivals and that his religious obligations would prevent him from attending. The hearing was set down for one of the two dates in question and Sessa applied for an adjournment. The prosecution and counsel for the defendants objected to the application on the ground ...

All lawyers know that research is key. Good research equals success, sloppy research equals all manner of problems. Naturally, we all want to do the highest quality research possible. But research is not cheap. On top of the time that it takes to read through cases, statutes, and treatises, we also need access to the right resources. What's more, in a small law practice time is always scarce. Solo practitioners and attorneys in two or three attorney firms don't have time to spend wading through barely relevant information.
