The case concerns the correct approach to the interpretation of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“ECHR”) in circumstances arising out of a foster care relationship where the person who had received or continued to receive that care is now an adult.   SM (Algeria) v Entry Clearance Officer, UK Visa Section [2015] EWCA Civ 1109   A child (SM) who was adopted in Algeria by a French couple living in the UK was refused an application for a right of entry as a family member. Having been overturned in the Upper Tribunal, the Entry Clearance Officer (ECO) successfully appealed to the Court of Appeal. SM was not, the court held, a family member of Mr M. A keen human rights observer might think this was an apparent infringement of article 8 ECHR (the right to family life). Their Lordships also refused to extend time for the Home Office to apply for permission to appeal in the cases of AC (Canada) and KG (India) . Boat Race protester Trenton Oldfield must leave UK

A man who disrupted last year's University Boat Race by swimming in front of the crews has been refused leave to remain in the UK. The Home Office said Trenton Oldfield's presence in the country was not "conducive to the public good". The Australian was jailed for six months after being found guilty of causing a public nuisance. Oldfield told Isleworth Crown Court that his actions were a protest against elitism and inequality. A Home Office spokesman said: "Those who come to the UK must abide by our laws. "We refused this individual leave to remain because we do not believe his presence in this country is conducive to the public good." Oldfield, who has a British wife, Deepa Naik, who is expecting a child, said he had appealed against the decision. "Moordenaar krijgt asiel" (volgens de Telegraaf - ik kan de bijbehorende uitspraak niet vinden)

DEN HAAG - De Iraakse moordenaar Moayad A., die werd veroordeeld wegens betrokkenheid bij een gruwelijke eerwraakmoord op zijn schoonmoeder en die de IND al jaren het land uit probeert te krijgen, mag definitief blijven. In het zoveelste hoger beroep, om de beslissing van de IND om hem als ongewenst vreemdeling het land uit te zetten, aan te vechten, heeft Moayad A. nu steun gekregen van de Raad van State. Dit hoge rechtscollege, het juridische eindstation voor de asielzoeker, vindt dat hij in Nederland mag blijven omdat hij hier een kind heeft verwekt. Volgens de Raad van State is uitzetting van de Irakees daarom in strijd met artikel 8 van het Europees Verdrag van de rechten van de mens. Volgens de Raad van State is het „bijzonder slecht” voor de dochter als het contact met de vader wordt verbroken omdat hij terug zou moeten naar Irak.
