The Netherlands violated a child’s rights by failing to acknowledge that he was stateless and eligible for international protection, a UN committee has found, urging the country to change its legislation. Op verzoek van het College voor de Rechten van de Mens (CRM) naar aanleiding van de gegeven input, heeft het Netwerk VN Vrouwenverdrag aanvullende informatie aan het CRM gegeven. De uiteindelijke oplossing voor het probleem van de juridische verblijfsafhankelijkheid van huwelijksmigranten ziet het Netwerk in een eigen, zelfstandige verblijfsvergunning. Dat is het meest wenselijke, maar helaas ook het minst haalbare. Het zou overigens wel kunnen: er wordt immers bijtoelating al voldoende gekeken of aan de voorwaarden van een “reële” relatie wordt voldaan. Door organisaties van (zwarte,migranten- en vluchtelingen)vrouwen en vrouwenopvang wordt al jarenlang gepleit om de termijn van juridische afhankelijkheid te verlagen naar maximaal 1 jaar, zoals deze ook geldt voor kinderen die via gezinsmigratie naar Nederland zijn gekomen. UNHCR is seeking comments on two new proposed guidelines, one on Article 1D and its application to Palestinian refugees, and the other on the definition of ‘habitual residence’. The deadline for submission is 9 January 2015. The Supreme Court is currently discussing a case that concerns Israel's practice of immediately returning asylum seekers who cross from Egypt into Israel back across the border. It appears that in so doing, Israel may be violating international law, according to a position paper submitted to the court by the United Nations High Commission on Refugees. The lawsuit in question was originally filed in 2007 by several human rights organizations represented by the Hotline for Migrant Workers and the refugee rights project of Tel Aviv University.
