Kijk gerust eens rond. Reference by Supreme Court to CJEU: Does Enhanced Protection Depend on Permanent Residence?

Reference by Supreme Court to CJEU: Does Enhanced Protection Depend on Permanent Residence? Posted on August 2, 2016 by mkp Secretary of State for the Home Department v Franco Vomero (Italy) [2016] UKSC 49 (27 July 2016) In analysing the future role of the courts in the post-Brexit legal landscape, Christina Lienen predicts a rise in EU law cases because of “people’s anxieties about their legal status and rights.” Noting that a number of complex EU law cases are pending before the Supreme Court, she concludes “that we will be in for a treat once the article 50 trigger is pulled.” Though a longstanding pre-Brexit matter, the case of Franco Vomero (FV) is one where the Supreme Court referred a series of questions about the interplay between of article 16 and article 28 of the Citizens’ Directive or 2004/38/EC . Almost four years ago, the Court of Appeal (Pill, Aikens and Rafferty LJJ, [2012] EWCA Civ 1199 ) held that a four-year period of impris...

The new Directive on immigration of students and researchers: a small step or a big leap forward?

Afbeelding
Steve Peers For a number of years, the EU has aimed to attract highly-skilled non-EU migrants to its territory. However, the existing legislation on this issue – the researchers’ Directive , adopted in 2005, and the students’ Directive , adopted in 2004 – have only had a modest impact on attracting more students and researchers to the EU, according to the Commission’s reports (see  here  and  here ) on the two Directives, issued in 2011. Consequently, the Commission proposed an overhaul of this legislation in 2013. The European Parliament (EP) and the Council recently agreed on the text of this proposal (for the text of the provisional version of the future Directive, see here ; the final version will be ‘tidied up’ a little legally). As you would expect, the EP and the Council compromised between their respective positions (for those positions, see  here and  here ), which I discussed in an earlier blog post. I’ll examine first the b...

Recent boek: The EU Citizenship Directive: A Commentary EBOOK Auteur: Steve Peers

The EU Citizenship Directive defines the right of free movement for citizens of the European Economic Area. It applies to EU citizens and their family members who move to another Member State. This might at first seem like a straightforward definition, but immediately questions arise. Who determines if a person is an EU citizen at all? What about dual citizens of two Member States, or of one Member State and a non-Member State (a 'third State')? What is the position of EU citizens who move to one Member State, and then return to their home Member State? This book provides a comprehensive commentary of the EU's Citizens' Directive tracing the evolution of the Directive's provisions, placing each article in its historical and legislative context. Special emphasis is placed on highlighting the connections and interactions between the Directive's constituent provisions so as to permit a global appreciation of the system of free movement rights to whic...

Commission refers Belgium to the Court of Justice of the European Union regarding the Single Permit Directive

Commission refers Belgium to the Court of Justice of the European Union regarding the Single Permit Directive The 'Single Permit Directive' ( Directive 2011/98/EU ) introduces a single application procedure for the issuing of single permits for non-EU nationals to reside and work in the territory of an EU Member State, and a common set of rights for non-EU workers legally residing in a Member State. The European Commission is referring Belgium to the Court of Justice of the EU for failing to transpose the Directive. The Single Permit Directive enables non EU workers to obtain work and residence permits via a single procedure, rather than requiring separate applications for residence and work permits. It also aims at providing a clear set of rules for third country nationals working legally within the EU so that they can benefit from common rights, similar to those of EU nationals, regarding working conditions, pensions, social security and access to public se...

EU: A hypersensitive issue: The rights to reside of an unemployable person by Emanuela Matei

In the aftermath of Dano, the value of the Union citizenship should be categorically re-examined. The decision of the CJEU in case C-333/13 from 11-11-2014 concludes that the safeguards in article 24 of the Directive 2004/38 and in article 4 of the Regulation no. 883/2004 on the equal treatment of the Union citizens must be interpreted as not precluding legislation of a Member State under which nationals of other Member States are excluded from entitlement to certain ‘special non-contributory cash benefits’ within the meaning of Article 70(2) of Regulation No 883/2004, although those benefits are granted to nationals of the host Member State who are in the same situation, in so far as those nationals of other Member States do not have a right of residence under Directive 2004/38 in the host Member State . Article 7 of the Directive 2004/38 read e contrario dictates that: unemployed people who have insufficient resources for themselves and their family members during thei...
