The Werkgroep Vreemdelingenrecht is a thinktank of dedicated immigration lawyers. Most of us are attorneys working in different firms but one of us teaches immigration law at a college. We pride ourselves in trying to give clients the best legal advice and assistance possible. That is why we meet on a regular basis to discuss the developments in our legal field and learn from each other's expertise. Moving to another country is complicated as it is but the legal aspects have so many loopholes and bogs that good advice is essential. And that is what we can offer. DEN HAAG - Volgens de Haagse rechtbank is 'jurist' Frank K. (52) uit Leiden een oplichter. De man zou asielzoekers juridisch begeleiden, maar hij geeft zich valselijk uit voor advocaat. Daarom veroordeelde de rechter hem tot 200 uur werkstraf, twee maanden voorwaardelijke celstraf en een geldboete van 750 euro, meldt het Leidsch Dagblad . Dat is dezelfde straf als het openbaar ministerie eiste tijdens de behandeling van de strafzaak twee weken geleden. K. verdiende aan vier asielzoekers uit Marokko, Iran en Irak ruim 11.000 euro. Dat honorarium zou te hoog zijn geweest voor het werk dat K. voor hen deed. "Today there are two cases before this court which we will refer to by the initials "B" and "J". As will become apparent when we set out the facts, there were, in essence, two explanations for what had happened in these cases. The first explanation is that the lawyers concerned were competent in the area of immigration law, but put forward applications to the court which, being competent practitioners, they must have appreciated were applications supported by arguments that were nonsensical. The other explanation was that those lawyers putting forward these applications were not competent in the area of the law and put forward applications in ignorance of the law that showed the lawyers were incompetent. To summarize the blogs I posted today: According to the Dutch courts: - Refused asylumseekers from Iraq can be deported to Jordan if Jordan agrees to take them back; - Algerian authorities do grant a laissez passer to their nationals who are illegal in The Netherlands as long as they declare to be willing to go back. The court states that that declaration can demanded from such illegal aliens; - Some Oeigoers lost their case against deportation to China. Ik vond deze in een stuk over het belang van rechtsbijstand in een Britse krant ( http://www.guardian.co.uk/law/2012/may/01/life-after-legal-aid?CMP=twt_gu ). Daar is deze week het mes gezet in toevoegingen. Lawyers have received millions of pounds to fight cases for immigrants who were eventually told to leave the country. By Rebecca Lefort 8:45AM BST 17 Apr 2011 A total of £11 million was spent on failed immigration and asylum cases, new figures show. Figures from the Legal Services Commission show another £6.3 million was spent on cases where the outcome was never known, and more than 1,000 cases were taken to judicial review, costing around £3 million. Each year £85 million is spent on legal fees for immigrants and asylum seekers trying to stay in the country. Many of the areas of taxpayers' money being spent will cause concern over whether it is being correctly spent. The figures show taxpayers spent £4.9 million on application or appeals to bring family members to the UK and £1.1 million on taking legal cases to allow family members to visit after they had been refused permission for a visitors visa to the UK. Facebook, blogs, and other online venues let lawyers reach a broader audience—including judges—so be careful what you say. A Florida attorney ripped a judge on a popular local blog after he was given one week to prepare for a criminal trial. The Florida Bar reprimanded and fined the attorney; on review the Florida Supreme Court upheld the fine. A Texas attorney asked for a trial delay because of a death in the family. The judge granted the attorney’s request, but then denied a second delay after viewing the attorney’s Facebook page and deciding the attorney was not expressing much grief. Creating an online presence for yourself is a great idea, but where do you draw the line? Think before you write, and remember that everything you post and write online is out there forever. If it sounds like something you wouldn’t say in court, do not post it. That might sound conservative, but it does not hurt your reputation or your bank account to err on the side of caution.
