Jurisprudence: EU child, discrimination by nationality and best interest of the child (discussing EU law and caselaw)

The case discusses is an English national permit but in the ruling a lot of EU passes the bar. Discussion Best interests of the child 18.          A child must not be blamed for matters for which he or she is not responsible, such as the conduct of a parent: see Zoumbas v Secretary of State for the Home Department [2013] UKSC 74 at [10] per Lord Hodge. There must be a full consideration of all relevant factors. 19.          The Court of Appeal developed the context for any assessment of the best interests of a child in EV (Philippines) v Secretary of State for the Home Department [2014] EWCA Civ 874 in these terms, at [58]: "...the assessment of the best interests of the children must be made on the basis that the facts are as they are in the real world. If one parent has no right to remain, but the other parent does, that is the background against which the assessment is conducted...

Alexander Schymyck writes: Surinder Singh route still requires genuine residence abroad The Court of Appeal has confirmed that in order to benefit from the Surinder Singh principle, the family involved must have genuinely resided in another EU country and have created or fortified their family life there. In Kaur and Ors v Secretary of State for the Home Department [2020] EWCA Civ 98 it rejected the argument that, as a result of the Court of Justice decision in C-202/13 McCarthy No.2, anyone with a residence card from another member state is entitled to have their family come and live with them in the United Kingdom. The facts of this case are not attractive. Mr Singh and Mrs Kaur had previously been married but divorced in 2004. The following year Mr Singh married a Polish national, obtained residence rights in the UK and bec...

1) The UK and the EU are currently negotiating the terms of an implementation period to commence after our withdrawal from the EU. The purpose of such a period is to give people, businesses, and public services in the UK and across the EU the time they need to put in place the new arrangements that will be required to adjust to our future partnership. 2) As part of these negotiations, the EU has proposed that the provisions on citizens’ rights in the Withdrawal Agreement should apply as of the end of the implementation period. Given the UK will leave the EU on 29 March 2019, and become a third country, we do not believe this is the right approach. The expectations of EU citizens arriving in the UK after our exit will not be the same as those who moved here before our withdrawal, and the same will be true of UK nationals moving to an EU Member State. It should therefore be for the UK and for Member States to determine the rights and pathways to settlement that new...
