Ambassadeur van Zimbabwe in Australiƫ vraagt asiel

SYDNEY, AUSTRALIA –  Zimbabwe’s ambassador to Australia has asked the Australian government for asylum, saying she fears for her safety and believes Zimbabwe President Robert Mugabe’s government is “illegitimate,” media reported Saturday. (..) Zwambila, who was recalled from her post after Mugabe won, has moved out of her residence but said she has no intention of flying back to Zimbabwe as scheduled next week. She said she is worried about being detained indefinitely amid threats of arrest after a court in Zimbabwe found that she owed money to a tradesman — a charge she denies. “I don’t feel safe about returning to Zimbabwe at all,” she told Fairfax media. Zwambila has asked the Australian government for protection visa so she can stay in the country. Prime Minister Tony Abbott’s office did not immediately respond to a request for comment. Supreme Court extends HJ (Iran) principle to political asylum seekers (ook belangrijke uitspraak voor NLDse rechtspraktijk

Asylum can be granted to a person who does not hold a political belief where this could lead to persecution, the Supreme Court has ruled in a case that potentially affects thousands of Zimbabwean refugees. In KM (Zimbabwe) v Secretary of State for the Home Department [2012] UKSC 38, seven justices considered whether asylum seekers without any particular political opinions should be required to lie and feign support for the Zanu-pf regime of President Robert Mugabe in order to avoid persecution. The appellant, KM’s son, had previously been granted asylum in the UK on the grounds he was a sympathiser of the opposing party, the Movement for Democratic Change (MDC), and feared for his life from the Zanu-pf militia. The secretary of state argued that KM could avoid persecution by lying about his views and pretending to support Mugabe. Kan je een politiek vluchteling zijn omdat je niet politiek actief wilt zijn? (Engelse uitspraak)

Enige weken geleden boog het hoogste Engelse gerechtshof zich over de vraag of iemand gevaar kon lopen bij terugkeer naar Zimbabwe omdat hij niet actief mee wilde doen in de pro-president activiteiten daar. Het werd een dagenlange zitting die kon worden gevolgd op internet en waar de centrale vraag was waartegen nou het Vluchtelingenverdrag bescherming biedt. Interessante Britse zaak over 1-f. Wanneer zijn het misdaden tegen de mensheid?

Meisje heeft meegedaan aan het verjagen van blanke boeren en hun personeel van boerderijen in Zimbabwe en vraagt later asiel in Engeland aan. De vraag die aan de orde komt is of dit gedrag valt onder "Crime against humanity of other inhumane acts". Zoals altijd bij Britse uitspraken is het veel uitgebreider gemotiveerd dan bij een Raad van State uitspraak. Dus ik adviseer u allen om de hele uitspraak te lezen die u hier vindt http://www.bailii.org/ew/cases/EWCA/Civ/2012/807.html. Wat mij opvalt is dat de vraag of haar gedrag onder misdaden tegen de mensheid valt wordt onderbouwd door uitspraken van het Joegoslavie Tribunaal en het Internationaal Strafhof.
